Health & Safety Notices — Terms & Disclaimer
These supplemental terms apply to the Health & Safety Notices feature of the Tuhdun service (the "Notices"), offered by Underhill Software LLC ("we", "us", or "our"). They add to, and do not replace, our general Terms of Service. Where these terms and the general Terms of Service both apply, both are in effect; the more specific provision controls for the Notices. By using the Notices, you agree to these terms.
1. What the Notices are
The Notices aggregate, summarize, and link to publicly available recall, outbreak, and safety information published by government agencies — including, for example, the U.S. Food and Drug Administration (FDA), the U.S. Centers for Disease Control and Prevention (CDC), and the U.S. Department of Agriculture (USDA). We collect this information from public sources, organize it, and — using automated tools, including artificial intelligence — produce short summaries and match it to locations or interests you tell us about. Each notice links to the underlying official source.
2. Informational only — not advice
The Notices are provided for general awareness only. They are not medical, health, dietary, or safety advice, and are not a substitute for the official guidance of a government agency or the judgment of a qualified professional (such as a physician or public-health authority). Do not use the Notices as the basis for any health or safety decision without consulting the official source and, where appropriate, a qualified professional. We do not create, endorse, or verify the underlying advisories — we point you to them.
3. No warranty — accuracy, completeness, and timeliness
The Notices are provided "as is" and "as available," without warranty of any kind. Government sources may be delayed, incomplete, superseded, or corrected over time, and our collection, summarization, and matching are automated and best-effort and may contain errors or omissions. We do not warrant that any notice is accurate, current, complete, or applicable to you, or that every relevant notice is shown. Always verify against the linked official source before you act.
4. Not affiliated with government agencies
Tuhdun is an independent service. We are not affiliated with, endorsed by, sponsored by, or acting on behalf of the FDA, CDC, USDA, or any other government agency or authority. Agency and organization names are used only to identify the source of the underlying information.
5. Relevance matching is best-effort
Any matching of a notice to your location, plans, lists, or interests is automated and approximate. Geographic and product information in a source is often partial — for example, a source may state a number of affected states without naming them, or describe only part of a larger outbreak. As a result, the absence of a notice, or a notice not being shown as relevant to you, is not an assurance of safety. You remain responsible for your own decisions and for checking official sources directly.
6. Alerts and communications
If you choose to receive alerts from us by email or text/SMS, you consent to receive those messages at the address or number you provide. Message frequency varies, and message and data rates may apply for SMS. You may opt out at any time — for email, use the unsubscribe link in any message; for SMS, reply STOP. We honor opt-out requests as required by applicable law, including the CAN-SPAM Act and, for text messages, the Telephone Consumer Protection Act (TCPA). How we handle your contact information is described in our Privacy Policy.
7. Paid features
Some alert or notification features may be offered for a fee in the future. When they are, current pricing and subscription terms will be published before they become effective. Paying for a feature does not change the informational, no-advice, and no-warranty nature of the Notices described above.
8. Limitation of liability
In addition to the "Limitation of liability" section of our general Terms of Service, and to the maximum extent permitted by applicable law, Underhill Software LLC and its members, officers, employees, agents, and affiliates will not be liable for any injury, illness, loss, or damages arising out of or relating to your use of, or reliance on, the Notices — including any delay, error, omission, mismatch, or failure to display a notice. Your use of the Notices is at your own risk.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these terms limits liability that cannot be limited under applicable law.
9. Governing law
These supplemental terms are governed by the laws of the Commonwealth of Virginia, United States, consistent with the "Governing law and dispute resolution" section of our general Terms of Service.
10. Changes to these terms
We may revise these supplemental terms as the feature evolves. When we do, we will update the "Effective date" above and post the revised terms at this URL. Continued use of the Notices after a change takes effect constitutes acceptance of the revised terms.
